Regarding the artificial ovary transplant: 1. A recent development of science meets the field of creating a female artificial ovary through which eggs are created. If we create eggs from an artificial ovary, for whom does the newborn belong? Is there any difference between giving birth from a normal ovary to an artificial one? Since the mother - as a group of scholars say - is the owner of the egg, not the incubator mother, the issue here is that the ovary is artificial, and the egg is made within the artificial ovary and this ovary is placed in the guts of a woman, so a question arose about who is the mother of the artificial ovary? 2. Is ovary manufacture is permissible at the first place? 3. Is it permissible for a woman who has a damaged (unproductive) ovary to deliberately replace it with an artificial one? 4. If a woman has a number of children and she wants to have children, is it permissible for her to use the artificial ovary that may require forbidden touching and sighting? 5. In relation to inheritance, does the infant of an artificial ovary inherit with the woman who became pregnant with it? 6. If a woman implanted an artificial ovary, and a person wanted to marry her, should she inform him of that? If she does not inform him, is this considered fraud and cheating? 7. If a man married a woman and it turned out that her ovary was artificial, and she had not informed him of that, does he have the right divorce her? And if he wants to divorce, is the dowry affected by that, so she takes less dowry compared to her counterparts? 8. A married woman whose ovary is not working. If she wants to implant an artificial ovary, is the husband's permission required to do so? 9. If someone (whether male or female) damages a woman's ovary and she wants to punish that someone who spoiled the ovary, then after we got the ability to make an ovary, is it permissible then to give the woman an artificial ovary in place of her damaged ovary? 10. On the same topic of replacing an ovary, should we burry the eradicated ovary or what?
Answer
1. In the name of Allah, whatever your speech is, my son, it should be known that if the artificial ovary is like a machine which creates an egg without the interference of the woman whom the artificial ovary implanted in, in this case, the child formed from this egg is not the son of a woman who has no effect according to her nature in the ovary or in the egg. If the sperm from which the egg was fertilized also was not taken from a natural man, then this baby is made up of an artificial egg and sperm that is not attributed to any father or any mother. And if the sperm is from a normal human and an artificial egg, then the owner of the sperm is the father of the child and it does not have a mother. Likewise, if egg is from a normal woman, and the sperm is purely artificial, then the baby has a mother and does not have a father. If the ovary is an artificial, but the egg was created from the effect of the force affecting the woman’s body such that the ovary is artificial and the egg is natural, then the child formed from this natural egg is considered the son of the owner of the egg.
