There is a treatment for infertility through the tubes, which is taking the egg or the sperm from other than the spouses and fertilizing it through the tubes. Is that permissible?
Answer
In the name of Allah, if the sperm is from the husband and the egg from the wife so that it is fertilized externally and then placed in the womb of the wife or a foreign woman and both cases are permissible, then the wife (the owner of the egg) is the mother of the baby and the husband (the owner of the sperm) is the father and the inheritance takes place between them and the owner of the womb (the foreign woman) is an incubator only. She does not have the right to ask for incubation fees unless there is a prior agreement and she cannot be the mother of the baby. The condition here is that the sperm should be taken out from the husband in a permissible way and without any forbidden act like uncovering the organs (of the wife of the woman) to the doctor, provided that there is a woman doing this work. Yes it permissible if it is necessary and it is part of the treatment. It is not permissible to fertilize a woman with a sperm of other than her husband. If it happens, the baby formed in this process belongs to the owner of the egg and the sperm, but the ruling of adultery is not applicable here. Allah knows best.
