Is it permissible for the testator to appoint an executor who is not among his immediate inheritors? Has anybody the right to object to that?
Answer
Choosing and appointing an executor whom the testator thinks fit for the job is the latter’s prerogative alone. The appointee should not necessarily be among his heirs. The heirs should have no right to object to that.
