If a person had died and left money, and he would have obligatory Hajj due on him: 1. Are the heirs obliged to hire the one who performs Hajj for him from the money that he left? 2. If one of the heirs refuses to take out the money that is sufficient for on proxy Hajj, what is the duty of the rest of the heirs?
Answer
In the name of Allah, if Hajj is due on him, then the Hajj cost is paid out of his inheritance, unless he recommends that it be taken out of one third of inheritance. If the one third is not sufficient for Hajj, then it must be taken out of the entire inheritance, regardless of the one third that is mentioned in the will. Allah knows best.
